1. Agreement to Terms

By downloading, installing, or using Gamemancer ("the App", "we", "us", "our") — available at gamemancer.gamemagic.org — you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use the App.

2. Description of the App

Gamemancer is a desktop application that uses AI agents to generate playable WebGL games. It provides:

• AI game generation — describe a game and the app builds a playable 2D or 3D WebGL game, iterating on and debugging its own output.
• Asset generation — 3D models, rigs & animation, worlds, images & textures, and audio, generated through the AI providers you connect.
• Bring-your-own-keys (BYOK) — you connect your own third-party AI provider accounts and/or local models. You are solely responsible for your use of, and any charges from, those providers.
• Export — export your projects to web (HTML5/WebGL), Unity, and mobile (React Native) formats.
• Optional integrations — optional connections to third-party tools such as Blender and ComfyUI, and to local model runtimes on your machine.

3. Eligibility

To use Gamemancer, you must:

• Be at least 16 years old, or have parental/guardian consent where required by your jurisdiction.
• Have a compatible desktop computer (Windows, macOS, or Linux).
• Provide accurate purchase information and keep your license key secure.

We reserve the right to refuse or terminate access at our sole discretion, including for violations of these Terms or abuse of the payment or licensing systems.

4. Licensing and Tiers

Gamemancer is a paid, one-time-purchase desktop application, offered in two tiers:

• Basic — a one-time license covering all game creation (2D, 3D and splat worlds), asset generation, and web export.
• Pro — everything in Basic plus React Native and Unity export, local-model support and pro integrations, per the pricing shown on our website. You can upgrade from Basic to Pro for the price difference.

Each license is granted to you, node-locked to a limited number of devices, and is non-transferable.

Gamemancer uses a bring-your-own-keys model: you connect and pay your own third-party AI providers directly. Your plan covers the Gamemancer software only — it does not include AI provider usage or any charges from those providers. Prices may change; any change does not affect a purchase already made.

5. Payments and Refunds

Payments are processed by our Merchant of Record, who handles the transaction, applicable taxes, and payment security. Their name appears on your receipt and card statement. Your purchase is also subject to their buyer terms, which govern the sale and your statutory rights.

6. Intellectual Property & Your Creations

The Gamemancer application — including its code, design, and all associated content — is protected by copyright and other intellectual property laws and is owned by us. You are granted a limited, non-exclusive, non-transferable license to use the App under these Terms.

You own what you build. The games, code, and assets you create with Gamemancer are yours, and you may use, publish, and sell them for any lawful purpose. We claim no ownership of your output.

You may not:

• Reverse-engineer, decompile, or disassemble the App, or circumvent its licensing.
• Copy, redistribute, resell, or create derivative works from the App itself or its code.
• Remove or alter any copyright, trademark, or proprietary notices.

7. Acceptable Use

When using Gamemancer, you agree not to:

• Attempt to gain unauthorised access to our servers or infrastructure.
• Use automated tools, bots, or scripts to interact with the App.
• Exploit bugs or glitches in a manner that disrupts other users or our systems.
• Impersonate Gamemancer or any other person or entity.
• Use the App in any way that violates applicable local, national, or international law.

8. Privacy

Your use of Gamemancer is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

9. Disclaimers and Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement.

To the maximum extent permitted by law, Gamemancer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date above. Continued use of the App after changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the jurisdiction in which Gamemancer operates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
